Rule Making (NPRM), that will provide the first update to the Fire Brigade Standards published 44 years
ago. The comment period for the Proposed Rule, will close on May 6, 2024, and will have significant
impacts for Fire, EMS, and Technical Rescue organizations. Join the AAA’s HR Operations Consultant,
Scott Moore, as he provides overview of the Proposed Rule’s new requirements. Which include
additional administrative obligations, job-related training, physical and mental health, initial and ongoing
assessments for emergency response employees. While the Proposed Rule has not been finalized, it is
clear that OSHA is committed to addressing the safety in EMS organizations.

Many EMT students are instructed that when they feel overwhelmed, they need to "be a duck"- paddling furiously under the water while everything stays smooth and calm on the surface. While this isn't terrible advice while actively running a call, many in emergency services take this advice to heart and embrace a brand of stoicism fairly unique to public safety. Avoidance is a nonadaptive coping style linked to increased risk of PTSD, burnout and suicide, yet it is the most commonly used method of coping with stress among EMS professionals. Types of avoidance coping such as dissociation, absenteeism and substance use will be explored. Learn healthier mechanisms to cope with adversity and ways to pass these skills along to your agency, creating a more resilient, present, and engaged workforce.

Sari Goldberg MS, NCC, EMT-P, is a veteran paramedic and mental health professional. After more than 10 years as a paramedic in the field, Sari earned a Master of Science in Clinical Rehabilitation and Mental Health Counseling from the University of North Carolina at Chapel Hill. Since 2019, she coordinates a comprehensive wellness program for employees at Guilford County Emergency Services that includes peer support, CISM, one on one interventions, and proactive psychoeducation.

In this webinar, we will discuss the basic coverage requirements for these plans, noting both the similarities to Fee-For-Service Medicare and several crucial differences. We will also discuss the cost-sharing amounts imposed on these plans, and how they may differ from FFS Medicare. Particular attention will be paid to prior authorization requirements that impact coverage of non-emergency ambulance transports. The discussion will then turn to the relative pros and cons of contractual arrangements with MA plans. On January 18, 2022, the Centers for Medicare and Medicaid Services (CMS) will expand the Prior Authorization Model for Repetitive, Scheduled Non-Emergency Ambulance Transportation (RSNAT) to those states located in MAC Jurisdictions E and J. The affected states are Alabama, California, Georgia, Hawaii, Nevada, and Tennessee, and the U.S. Territories of American Samoa, Guam, and the Northern Marianas Islands. Under the RSNAT Model, prior authorization will be required for all non-emergency ground ambulance transports furnished by Part B ambulance suppliers on a repetitive basis (i.e., situations where the patient requires transportation three or more times for the same service over a set period of time). Please join A.A.A. Medicare Consultant Brian S. Werfel, Esq. for a discussion on how the RSNAT Model will impact the provision of repetitive ambulance transports in these states and territories. This will be the first in a series of A.A.A. webinars focused on the Prior Authorization Model for Repetitive, Scheduled Non-Emergency Ambulance Transportation (RSNAT). When fully implemented, the RSNAT Model will require prior authorization for all non-emergency ground ambulance services furnished by Part B Ambulance Suppliers on a repetitive basis, i.e., situations where the patient requires transportation three or more times for the same service over a set period of time. In this first installment, we will focus on the technical elements of the RSNAT Model, including the timelines for the initial authorization request, the timeline for follow-up requests, the basic documentation requirements, etc. Brian will then discuss the impact of prior authorization on dialysis transportation payments in those states that participated in the original demonstration project from 2014 to 2021. The session will conclude with a Q&A period for attendees to ask any questions they may have.

We’re in a perfect storm! In many communities, the Delta Variant has stressed healthcare systems to the max, and dramatically increased EMS response volume. Staffing in EMS and hospitals is critically low, hospitals are nearly full, and 911 call volume in some communities at record levels. The eye of this storm is the hospital emergency department. Patient volume at record levels, patients in the ED on observation status, and even patients awaiting inpatient beds are resulting in delays for ambulance crews trying to transition patients from their care to the ED staff. Numerous agencies across the country are reporting 60, 90, and 120+ minute delays getting patients into the ED. At the same time, some hospitals are seemingly able release EMS crews rather quickly, so they can respond to other 911 calls in the community.

A panel of experts for AIMHI member agencies, EMS legal and EMTALA experts, representatives from Centers for Medicare and Medicaid, and hospitals who have seemed to master the EMS turnaround speed will share their best practices for mitigating ED delays, and the legal consequences of ambulance parking. AIMHI will also present the results of their FLASH POLL on ED turnaround delays, and data from nearly 6 million patient care records from ESO will be presented to quantify the gravity of this challenging issue.

On July 1, CMS issued a proposed rule on Surprise Billing, which applies to those providers and physicians identified in the No Surprises Act. This statute subjected ground ambulance suppliers to an HHS Advisory Committee process prior to any rulemaking addressing these services.

The consultants and staff of the American Ambulance Association are doing a deep dive into the 400+ page rule and evaluating its nuances. We continue to understand from our conversations that ground ambulances are not included and instead are subjected to the Advisory Committee.

The American Ambulance Association will soon provide a summary to members, and will address any confusion with the Administration.

OHSA’s New Emergency Temporary Standard: What EMS Employers Need to Know
On June 21, 2021, the U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) published its COVID-19 Emergency Temporary Standard (“ETS”), meaning the new regulations are now effective. Covered healthcare employers must comply with most of the requirements of the ETS by July 6, 2021. These new standards apply to employers subject to OSHA’s jurisdiction, and in all settings where employees provide healthcare or healthcare support services.
This webinar will analyze the applicability of the ETS to EMS organizations, many of which, EMS employers implemented long before the ETS was issued. However, these new standards include extensive workplace hazard assessment and documentation requirements that many EMS employers must be able to produce to for regulators. OSHA has emphasized that healthcare employers, including EMS organizations, are the focus of the department’s enhanced enforcement efforts to ensure compliance with these new standards. We will also discuss how EMS employers can utilize many of the OSHA Sample ETS documents and resources the department has created to assist healthcare employers in complying with this standard.

There has been a wave across the U.S. of legislation that has legalized medicinal and recreational marijuana. This wave has caused considerable challenges for EMS employers given the nature of the work performed by the EMS workforce. In many instances, the state law prohibits an employer from discriminating or taking other disciplinary action against workers for their off-duty marijuana use. Many EMS employers are federal contractors or grantees and must abide by the Drug Free Workplace Act of 1988. However, due to the newness of legalized marijuana, the application of the state and federal law has not played out in the courts allowing employers to understand how to ensure compliance with laws that appear to contradict each other. EMS attorneys, Margaret Keavney of Keavney & Streger, LLC and Scott Moore, AAA HR and Operations Consultant will host a point-counterpoint town meeting where they will discuss the intersection of current law and will provide recommendations for EMS leaders to ensure that they are providing a safe working environment for both employees and patients.

It goes without saying that the past year has been a tumultuous one for the EMS industry. The past year has seen EMS agencies scrambling to find the operational and financial resources to ensure that they could respond to the COVID-19 pandemic. The federal government has responded with unprecedented levels of financial relief for individuals, businesses, and health care providers. The Centers for Medicare and Medicaid Services has also made sweeping changes to the Medicare Program’s coverage of ambulance services. At the same time, our industry has been preparing for the roll-out of Medicare cost-data collection, the implementation of the Emergency Triage, Treatment, and Transport Program (ET3), the national expansion of prior authorization for repetitive patients, and numerous other changes in Medicare’s coverage of ambulance services.
Join A.A.A. Medicare Consultant Brian S. Werfel, Esq. for a retrospective look at some of the more significant changes impacting the reimbursement for ambulance services. Last week, the Centers for Medicare and Medicaid Services (CMS) announced that they will be further delaying the mandatory ambulance cost data collection reporting until 2022. Cost collection was originally scheduled to start for 25% of EMS providers in 2020 and was delayed until 2021 due to the pandemic. CMS announced that, due to the continued impacts of the COVID-19 pandemic, they will be pushing back the reporting requirements for 50% of the EMS providers until 2022.
It is more important than ever that EMS leaders prepare their organizations and align their financial practices and data systems to meet the requirements for the COVID-19 Provider Relief Fund (PRF) reporting requirements beginning early in 2021, as well as, for the ambulance cost collection requirements starting in 2022. This webinar will discuss how the AMBER cost collection platform can assist EMS agencies in telling their pandemic-related financial story, ensuring that they can articulate the impacts to their services with real-time financial data. We are in a new era of financial accountability and any future COVID-19 related relief will require supporting financial data. The headlines are highlighting the fragility of the nation’s EMS systems. Accurate financial data will tell the story that cannot be ignored.

This webinar will provide a review of the year many of us would like to forget.
